Seller agrees to sell Buyer a puppy with the following agreement.

 

1. The Buyer agrees to provide a life-long commitment, comfortable environment, prompt medical attention, proper grooming and responsible care. This includes keeping this puppy/dog parasite free and up to date with inoculations, proper nutrition, which consists of a good quality professional feed given at regular intervals, and fresh water available at all times. The Buyer promises to provide a safe environment for the dog, and never allow the dog to roam freely without proper fencing or supervision. The Seller strongly recommends that the puppy/dog be micro-chipped in order to facilitate his return if lost or stolen.
  2. The Seller guarantees this puppy/dog to be of sound health and temperament at the time of this sale. A health record of all shots and/or worming will be provided by the Seller. The Buyer agrees to take this dog to a licensed veterinarian of their choice within 72 hours for a physical examination. Should puppy/dog be determined to be in ill health, the cause of which the Seller is clearly to blame, the dog may, upon a signed written diagnosis from said licensed veterinarian, be returned for refund of the purchase price. The Seller assumes absolutely no responsibility for fees associated with caring for the puppy/dog. No other guarantees are given.

3) The Buyers agree not to use this animal for breeding and agree to have it spayed/neutered at the age recommended by their veterinarian (usually 6 months to 1 year of age). This dog will be on limited AKC registration.
4) If at any time the Buyer can no longer retain possession of this dog, the Seller is to be notified and given first option of resuming full ownership of dog in order for the Seller to locate this dog a new home.

 

  Refunds, if any, will be at the discretion of the Breeder/ Seller. The dog will be returned with all AKC papers and medical records. Should any circumstances arise that affect the quality of life of the dog, the breeder/seller is to be informed so that they may participate in determining the future of the dog. The Breeder/ Seller reserves the right to approve/prohibit any transfer of this animal to a third party. Under no circumstances will this dog be sold, leased, traded or given away to any pet shop, research laboratory, animal shelter or similar facility.
5) The Buyer agrees to contact the Seller immediately if any questions or concerns arise about the dog, such as housing, diet, or health. The buyer agrees to keep the seller informed of any treatment as it occurs. This provides the Breeder/Seller with an opportunity to follow up on puppies and gives us important feedback and information on the health or our dogs for future generations.
 6) Seller / Breeder DOES NOT Guarantee color,size,breeding/show quality, House breaking or train ability.

 

7) Registration papers will either be provided at time of sale of the puppy or transferred to the Buyer immediately upon receipt from AKC if they are still being processed. It is understood at the time of sale that this is a pet quality dog and it is representative of its breed. Training classes are highly recommended for a happy relationship between the dog and family.

   The preceding paragraphs contain conditions established by the Seller to ensure the well being of the puppy/dog. The Buyer’s agreements will continue for the duration of the dog’s life and the Seller will have the right to enforce the agreements.

   Buyer further agrees to maintain the dog at all times in good health with periodic checkups, heartworm treatment, NuVet vitamins and recommended immunizations, for the life of the dog. Contingency on three year Health Guarantee:

  1. Buyer will continue to give puppy 1/2 wafer of the NuVet Plus each day until puppy weighs 10 pounds, and 1 full NuVet Plus wafer every day after 10 pounds, for the entire 3 years of this Health Guarantee. Your puppy has been supplemented with NuVet Plus vitamins since starting on dry food. This vitamin contains powerful antioxidants which eliminates free radicals and boosts the immune system, creating a preventative against skin and coat problems, various forms of cancer, heart disease, arthritis, cataracts, premature aging, tumors, digestive problems, and allergies.   • Barkleys Scottish Terriers does not guarantee against allergies or skin conditions. Seller/breeder assumes no responsibility for medical expenses, veterinary expenses, morality, allergy to animal, disagreement of family, neglect, etc...

  • Seller/breeder shall not be held responsible for any acts of the puppy or any other expenses incurred once said dog/puppy leaves seller's possession. All shipping charges are the responsibility of the buyer and are Non-Refundable.
Puppy is guaranteed for 3 years from the date of purchased against genetic defects ( excluding allergies) only if the following guidelines are followed exactly.

a) The buyer must notify seller of any genetic defect immediately.

b) A written statement as to the genetic defect must be provided to us from buyer's veterinarian.

c) A written second opinion from breeder’s veterinarian must be provided to us from buyer at breeder’s expense.

d) Seller's veterinarian will examine the puppy. After these guidelines are followed, if there is a genetic defect present we will provide a replacement puppy of the same value and purchase price.

If a genetic defect is found by your vet within the three years, puppy will be replaced as soon as one of equal value is available. No money refunded, only replacement of puppy. In order for us to replace the puppy, we will need all tests, xrays, and medications given by your vet. We will also need your vet’s phone number in case there are any questions. After receiving the documentation it will be given to our vet to review. If Sellers vet believes it is hereditary, puppy will be replaced. Puppy will not be replaced without documentation. Before any surgeries or treatments are done on puppy found to have genetic defects Barkleys Scottish Terriers is to be contacted. SELLER IS NOT RESPONSIBLE FOR ANY BUYERS VET BILLS. HEALTH GUARANTEE IS FOR REPLACEMENT OF PUPPY ONLY. WE DO NOT REFUND ANY MONEY FOR ANY REASON.

  Limitations of All Guarantees: Medical Treatments/Expenses- Under NO CONDITION will we refund, replace, or treat a puppy, where we are not notified of its being ill within 48 hrs. We may require documentation from your vet as well as to speak to them so please have this information available. We reserve the right to have a 2nd opinion at a vet of our choosing. Seller claims no financial responsibility for any surgery or procedures of any type.
